This module presents the regulations based on the Resource Conservation and Recovery Act (RCRA), assisting users in the identification of non-hazardous solid waste, hazardous waste, used oil, universal waste, and some forms of radioactive waste. For use at any facility that has air emissions, may be regulated as a major source or an area source under the Clean Air Act, or manufactures or uses any product containing an ozone-depleting substance. This module guides users through the major regulatory programs stemming from the Clean Air Act and its amendments. It addresses Title V Permits, PSD, NSR, Acid Rain, NSPS, Ozone-Depleting Substances, Risk Management Programs, and NESHAPs. Given the complexity and permit-driven nature of these programs, there is no single set of air requirements that applies to every facility; for this reason, Dakota enables the user to customize the provided framework to include permit requirements and other facility-specific information.

For use at facilities with existing or closed storage tanks. This module provides a comprehensive review of the regulation of underground storage tanks (USTs) under the federal Underground Storage Tank program. It enables users to determine which sections of the regulations apply to its USTs and to identify specific requirements for managing its USTs. While there is no federal program specifically for aboveground storage tanks, the module provides the user with the option to capture state or local requirements that may apply to these tanks.

For facilities where Polychlorinated Biphenyls (PCBs), PCB items, or PCB waste are present, or have been disposed or released. This module includes requirements under The Toxic Substances Control Act (TSCA) that apply to PCB management. Topics include the use, storage, and disposal of PCB transformers, capacitors, and other PCB items; storage and disposal of PCB wastes; and PCB spill cleanup requirements.

For use at facilities that handle chemical substances, this module reviews the TSCA requirements for toxic substances other than PCBs. It reviews record keeping, reporting and requirements concerning allegations of significant adverse reactions to health and environment, substantial risk reporting, chemical information rules, import/export, pre-manufacture notification, microbial commercial activity notification, and other areas in TSCA. It also includes an overview of the Lautenberg Chemical Safety Act that modernizes elements of the original Toxic Substances Control Act.

For use at facilities which are engaged in drilling, producing, gathering, storing, processing, refining, transferring, distributing, using, or consuming oil and oil products or at which hazardous substances are handled. This module determines applicability of and provides the requirements for spill prevention, control, and countermeasure (SPCC) for petroleum and non-petroleum oils. Response Plan requirements under the Oil Pollution Act are also covered. Release reporting requirements under the Clean Water Act and OPA are reviewed. Users are provided with an outline for applying SPCC planning requirements to hazardous substances currently not regulated under these rules.

This module describes the various requirements for emergency response planning, notification, and reporting for facilities producing, using, or storing different classes of hazardous chemicals. Good management practices (GMPs) for Pollution Prevention, Waste Minimization, and Chemical Risk Management are also included.

For any facility that prepares hazardous materials for transport or is a transporter of hazardous materials, employers and drivers of commercial motor vehicles transporting property or passengers in interstate commerce, or facilities located in, under, on, or adjacent to waters subject to U.S. jurisdiction and engaged in operations that may pose a security threat. This module reviews the Department of Transportation’s (DOT) requirements for shipping and transporting hazardous materials. It includes DOT training requirements; security plan requirements; emergency response information; and shipping preparation, including documentation, marking, labeling, placarding, and packaging. It covers commercial driver’s license regulations, drug and alcohol testing requirements, driver qualification, equipment safety, hours of service, inspection, repair and maintenance requirements for employers, and drivers involved in interstate motor carrier operations. United States Coast Guard (USCG) regulations implementing the Maritime Transportation Security Act of 2002 are also included and cover requirements for facility security assessments and plans, security measures, compliance with Maritime Security Levels, and training.
