OSHA Withdraws COVID-19 Vaccination and Testing Emergency Temporary Standard

Summary: OSHA is withdrawing the COVID-19 Emergency Temporary Standard (ETS) for Vaccination and Testing, which was published on November 5, 2021 (86 FR 61402) and subsequently stayed by the U.S. Supreme Court on January 13, 2022. Although OSHA is withdrawing the ETS as an enforceable emergency temporary standard, the ETS continues to serve as a proposed rule subject to notice and comment rulemaking in the proceeding to promulgate a permanent COVID-19 occupational safety and health standard.
