EPA Establishes Allowance Allocation and Trading Program for Phasedown of Hydrofluorocarbons

Summary: EPA is implementing an allowance allocation and trading program to phase down hydrofluorocarbon (HFC) production and consumption, as directed by the American Innovation and Manufacturing (AIM) Act enacted on December 27, 2020. The program (40 CFR 84) establishes HFC production and consumption baselines; an allowance allocation program; an initial approach to allocating calendar-year allowances; provisions to support implementation of and compliance with the phasedown of HFC production and consumption; and recordkeeping and reporting requirements. Portions of the rule related to allowance allocations are effective October 5, 2021, with the remaining portions of the rule effective November 4, 2021.
