FWS Returns to Former Interpretation of Migratory Bird Treaty Act

Summary: The Fish and Wildlife Service (FWS) is revoking the January 7, 2021 (86 FR 1134) final rule that limited the scope of the Migratory Bird Treaty Act (MBTA) to intentional acts directed against migratory birds, their nests, or their eggs. With this revocation, FWS returns to implementing the MBTA as prohibiting incidental take.
