President Signs Congressional Review Act Resolution to Disapprove EPA's 2020 Oil and Gas Policy Rule

July 8th, 2021 by Ann Rippe

Action Forcing Change
Summary: The President of the United States signed into law a joint resolution under the Congressional Review Act (CRA) disapproving EPA's Oil and Gas Policy Rule which was finalized on September 14, 2020 (85 FR 57018, "2020 Policy Rule"). The 2020 Policy Rule revised the NSPS for the oil and natural gas sector (40 CFR 60, Subpart OOOO and 40 CFR 60, Subpart OOOOa) by finalizing the determination that the source category includes only the production and processing segments of the industry and rescinding VOC and methane standards applicable to the transmission and storage segment and methane-specific requirements applicable to sources in the production and processing segments. The CRA resolution immediately reinstates the standards that applied to the transmission and storage and the production and processing segments prior to the 2020 Policy Rule. Further details on the impact of the resolution can be found in EPA's question and answer document.
