EPA Rescinds and Modifies Significant Portions of the Risk Management Program Amendments Rule

Summary: EPA is rescinding and modifying significant portions of the provisions finalized in the Risk Management Program Amendments rule, which was issued on January 13, 2017 (82 FR 4594), to address petitions for reconsideration. Specifically, EPA is rescinding all requirements for third-party compliance audits; safer technology and alternatives analysis requirements for facilities with Program 3 regulated processes in the paper manufacturing, petroleum and coal products manufacturing, and chemical manufacturing industries; requirements for incident investigations; requirements for making chemical hazard information available to the public; and other minor provisions. Additionally, EPA is modifying the requirements for local emergency response coordination and emergency response exercises. The final rule requires immediate compliance with the revised emergency response coordination requirements, and includes a delayed compliance schedule to allow time for covered processes to comply with the revised requirements for emergency response exercises, public meetings, and risk management plans.
