Disposal of Coal Combustion Residuals from Electric Utilities

Proposed Rule Change
Summary: EPA is proposing to revise the Coal Combustion Residuals (CCR) final rule as it applies to landfills and surface impoundments promulgated on April 17, 2015 (80 FR 21302) and portions vacated by the D.C. Circuit Court of Appeals on August 21, 2018. The proposed revisions would implement the court's vacatur and reclassify "clay-lined" impoundments from "lined" to "unlined", change the deadline by which unlined CCR surface impoundments and units that fail the aquifer location restriction must cease receipt of waste from October 31, 2020 to August 31, 2020, and change the alternate closure provisions to grant additional time to affected facilities to develop alternate capacity for managing wastestreams.
