Court of Appeals Vacates Delay of Effective Date of Risk Management Program (RMP) Revisions

Action Forcing Change Summary
The U.S. Court of Appeals for the D.C. Circuit is vacating the June 14, 2017 (82 FR 27133) final rule which delayed the effective date of the revisions to the Risk Management Program (RMP) which were published on January 13, 2017 (82 FR 4594). The June 14, 2017 rule delayed the effective date of the RMP revisions from June 19, 2017, to February 19, 2019, and also delayed the compliance date for the RMP emergency response coordination provisions in 40 CFR 68.93 to February 19, 2019. EPA has not yet officially withdrawn the June 14, 2017, final rule from the Code of Federal Regulations.
