EPA Delays Applicability of 2015 Definition of "Waters of the United States"

Applicability Change Summary
EPA is adding an applicability date of February 6, 2020 to the version of the definition of "Waters of the United States" that was codified in the Code of Federal Regulations (CFR) in the June 29, 2015 (80 FR 37054) Clean Water Rule to delay its implementation for two years. During the two year period, the definition that existed prior to the June 29, 2015 rule will remain effective to provide continuity and regulatory certainty when determining the applicability of oil discharge, oil pollution prevention, and NPDES permit requirements while EPA continues to review and evaluate potential revisions to the 2015 rule.
