Court Delays Implementation of Certain NSPS Standards for Oil and Natural Gas Sector

Action Forcing Change Summary
The U.S. Court of Appeals for the D.C. Circuit granted EPA a 14-day delay in implementing the court opinion of July 3, 2017 that immediately vacated the EPA's June 5, 2017 (82 FR 25730) stay of certain provisions of the NSPS for the Oil and Natural Gas sector (40 CFR 60, Subpart OOOOa) which were promulgated on June 3, 2016 (81 FR 35824). The EPA's original request for a 52-day delay was rejected; however, the shorter period of 14-days was granted in order to give EPA time to determine whether to seek panel rehearing, rehearing en banc or pursue other relief.
