Court Vacates Stay of Certain NSPS Standards for Oil and Natural Gas Sector

July 7th, 2017 by Ann Rippe

Action Forcing Change Summary
The U.S. Court of Appeals for the D.C. Circuit is vacating EPA's June 5, 2017 (82 FR 25730) stay of certain provisions of the NSPS for the Oil and Natural Gas sector (40 CFR 60, Subpart OOOOa) which were promulgated on June 3, 2016 (81 FR 35824). The June 5,2017 rule stayed the fugitive emission requirements, well site pneumatic pump standards, and requirements for certification by a professional engineer for three months, from June 2,2017 through August31 2017. The Court's vacatur of this stay requires that facilities be in compliance with these provisions by the original compliance dates specified in the June 3,2016 rule. This vacatur does not impact the EPA's proposal published on June 16, 2017 (82 FR 27645) to reconsider and stay the June 3,2016 final rule for two years.
