EPA Issues Final 2017 NPDES Construction General Permit (CGP)

Action Forcing Change Summary
EPA is issuing the final 2017 NPDES Construction General Permit for stormwater discharges from construction activities (2017 CGP). The final permit replaces the existing general permit covering stormwater discharges from construction activities that will expire on February 16, 2017 (2012 CGP). The 2017 CGP is similar to the 2012 CGP and includes effluent limitations, requirements for self-inspections, corrective actions, staff training, development of a stormwater pollution prevention plan (SWPPP), and permit conditions applicable to construction sites in specific states, Indian country lands, and territories. Differences from the 2012 CGP include streamlined and simplified language; revisions to the technology based limits language to incorporate the 2014 amendments to the Construction and Development Effluent Guidelines and Standards; new signage requirements for specifying how to obtain a copy of the SWPPP; revised requirements for temporary stabilization of stockpiles and land clearing debris piles which are unused for 14 or more days; a modified approach to stabilization deadlines to phase construction disturbances; new requirements to keep construction and domestic waste container lids closed or otherwise covered; controls on sites discharging to PCB-impaired waters; and revisions to questions on the Notice of Intent (NOI) form. The final 2017 CGP is effective February 16, 2017and will be effective for five years.
