Cleveland, Ohio - March 24, 2010 - Dakota Software, a leading provider of sustainability and Environmental Health and Safety (EHS) auditing and compliance solutions, is one of 20 firms recently profiled in Groom Energy Solution’s industry report titled Enterprise Carbon Accounting, An Analysis of Corporate-Level Greenhouse Gas (GHG) Emission Reporting and a Review of GHG Software Products. Cleveland, OH -- October 12, 2009 -- Lisa Jackson, EPA’s new Administrator signed the Final Mandatory Reporting of Greenhouse Gases (GHG) Rule on September 22, 2009. The rule establishes mandatory annual GHG reporting requirements for owners and operators of large GHG emission sources and certain fossil fuel and industrial GHG suppliers in the U.S. The gases covered by the proposed rule are carbon dioxide (CO2), methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFC), perfluorocarbons (PFC), sulfur hexafluoride (SF6), and other fluorinated gases including nitrogen trifluoride (NF3) and hydrofluorinated ethers (HFE). The new program is expected to cover approximately 85 percent of the nation’s GHG emissions and apply to roughly 10,000 facilities.

To comply with the new rule, facilities must first determine whether or not they exceed any of the applicability thresholds. If they do, they must comply with the rule’s General Provisions (Subpart A), which include requirements for general monitoring, data collection, reporting, recordkeeping, and emissions verification. Once subject to the rule, facilities must then determine whether they are subject to any of the thirty source categories included in the rule (Subparts C through PP), and must then comply with all applicable source category-specific requirements and procedures for calculating emissions, monitoring and QA/QC, estimating missing data, reporting, and recordkeeping. Eleven additional source categories are still under review by the EPA and may be added to the rule in future rulemaking decisions.

Data collection under the new GHG rule for calendar year 2010 will begin on January 1, 2010, with the first annual GHG report due to the EPA on March 31, 2011. Although this rule has not yet been published in the Federal Register, Dakota Software is actively developing functionality that addresses its requirements and will distribute those changes in an upcoming release. Users can anticipate having expanded tools for identifying new regulatory information and tracking the subsequent revisions and additions that will no doubt follow. These changes can then be incorporated into company and facility profiles to drive needed changes to compliance programs.

To further enable proactive compliance with the new GHG rule, Dakota Software has launched and integrated Metrics into the suite of ProActivity products. Metrics simplifies data gathering, analyzing and reporting on GHG and other company-specific sustainability measurements. It provides verifiable audit trails and simplifies data collection using smart forms. To ensure accurate sustainability monitoring and reporting, Metrics consolidates data at the enterprise level and displays related EHS data in a flexible, easy-to-read dashboard format.

The interim final rule (72 FR 17688) of the Chemical Facility Anti-Terrorism Standards has been published. The Department of Homeland Security (DHS) in what is being emphasized as a "partnership" between chemical facilities and the DHS, is proposing a list of chemicals and quantities--called "Appendix A". If your facility possesses any of the chemicals in Appendix A, you will be subject to the above standards. The DHS intends to ensure plant compliance with its new security plan by initiating on-site inspections.

Dakota's new International Protocol collection, authored by ENHESA-EPC, now includes new versions of France, Mexico, Australia-Victoria, United Kingdom-England and Canada-Ontario.

February 6, 2007---Rochester, NY--- Dakota announces the release of Auditor Version 6.8. The highlights of regulatory changes in Version 6.8 include Sealed Sources Transactions Upcoming Compliance Deadlines. The final rule issued by the Nuclear Regulatory Commission implementing the National Source Tracking System for transactions involving sealed sources, requires the licensee to report information on the manufacture, transfer, receipt, disassembly and disposal of nationally tracked sources. Compliance dates for initial inventory submitted to the National Source Tracking System are Nov. 15, 2007 and Nov. 30, 2007 for Category 1 and Category 2 Sources respectively. The Dakota Auditor Reference Library and applicability and checklist questions have been updated to include the new information in the Chemical and Physical Exposures Module as well as the Solid and Hazardous Waste Module.

New Ground Water Rule for Drinking Systems

The new Ground Water Rule topic has been added to the Drinking Water section in the Water Quality Module. The rule establishes a risk-based approach to target ground water drinking systems that are susceptible to fecal contamination, requiring source water monitoring at targeted systems and corrective actions for systems with an identified significant deficiency or evidence of fecal contamination. The final rule, effective Jan. 8, 2007 applies to ground water systems that do not combine all of their ground water with surface water or with ground water under the direct influence of surface water prior to treatment under 40 CFR 141.

Dakota introduces three new International Protocols authored by ENHESA-EPC: Sweden, European Union and the Flemish region of Belgium. The Germany protocol has also been updated. Audit Migration

With this newest upgrade, you’ll be able to quickly migrate an audit from a prior version of Auditor to the new database in 4.0. If you are auditing similar facilities on multiple occasions, there is no need to start an audit from scratch. Much of the information that was captured during prior audits may still be relevant to upcoming audits. You can simply transfer responses from an existing audit to the new audit. The original audit is not affected by the transfer process and the new audit is automatically migrated to the latest version of the database. Answers to applicability questions are transferred to the new audit for you to review and revise if necessary, and you have the option to transfer responses to checklist questions for validation. Based on current circumstances, you can accept or reject an answer from a checklist question from a previous audit.  

 

Red Flag Update

Red Flags from prior audits can be automatically transferred to current questions. If you have a concern about a recurring compliance issue, you simply choose the “Repeat Red Flag” option.

 

Expanded Search Capabilities

Additionally, enhanced search capabilities in the Reference Library enable you to refine your search to bring you more targeted, exact results.

 

Filters

Dakota announces the release of Auditor Version 6.4 which now includes Abridged Protocols in the Worker Safety, Solid & Hazardous Waste and Water modules. 

 

The new, automated and hyperlinked Abridged checklist questions highlight key regulatory requirements for the major topics of a module. These abridged questions can be used alone or in conjunction with the detailed checklist questions to tailor the audit protocol to the user’s experience level, the nature of the facility and the relative importance of the regulatory topics making it easy to fine tune the level of detail for each audit.

 

The highlights of regulatory changes in Version 6.4 include information in the Solid & Hazardous Waste module about the Nuclear Regulatory Commission’s proposed amendment to the regulations implementing a National Source Tracking System for certain sealed substances. The Chemical & Physical Exposures module contains information regarding this proposal also as each licensee who manufacturers, transfers, receives or disposes of a nationally tracked source would be required to complete and submit NRC Form 748. The licensee’s initial inventory of nationally tracked sources would have to be provided and then annually verified and reconciled with the actual inventory.

 

The Air module reflects EPA’s final published rule establishing standards of performance for mercury for new and existing coal-fired electric utility steam generating units. The final rule revised new source performance standards, added emissions guidelines and compliance times and revised continuous emissions monitoring requirements in 40 CFR 75.

 

The Federal Motor Carrier Safety Administration (FMCSA) proposed a new Federal on-line registration system that would apply to every motor carrier, freight forwarder and broker required to register with DOT under 49 CFR 390.19 or 49 U.S.C. 13901. The entities covered by a Unified Registration System would be required to register with FMCSA and periodically update registration information provided on a newly proposed registration form. Version 6.4’s Transportation module contains a summary of the proposed rule in the Reference Library with links to the appropriate checklist questions.

Air- In response to customer requests, the NSPS for Bulk Gasoline Terminals (40 CFR 60, Subpart XX) has been expanded to include the full text of the standard in the Auditor Reference Library and summary checklist questions.

Pipeline Safety- Operators of gas transmission pipelines located in high consequence areas (HCAs) are now required to develop Integrity Management Programs which require operators to perform ongoing assessments of pipeline integrity; to improve data collection, integration and analysis; to repair and remediate the pipeline as necessary; and to implement preventative and mitigative actions.

Full text coverage of the Integrity Management Program (49 CFR 192, Subpart O) is presented in the Reference Library along with appropriate applicability and checklist questions for those facilities subject to the Integrity Management Program requirements.

Transportation- The final rule establishing standards for Minimum Training Requirements for the operators of Longer Combination Vehicles (LCVs) and for the instructors who train these operators is effective June 1, 2004. A new part (49 CFR 380) was added to the Auditor Reference Library and a new LCV domain was added to the Transportation>Motor Carrier Safety topic.

Under the amended Federal Motor Carrier Safety Regulations (FMCSRs) (69 FR 16684), new or prospective employers are now required to seek minimum driver safety history performance data for applicants under consideration. Dakota’s Reference Library was revised and a new checklist question was added to address the newly mandated Driver Investigation History File.

The newest requirements for Facility Security mandated by the Coast Guard can be found in the Transportation Module. The new regulations affect all facilities located at or near a body of water. Regulatory coverage in the Reference Library includes the General Provisions (33 CFR 101) and Facility Security Requirements (33 CFR 105). "Maritime Transportation Security" is a new topic in the Navigator with associated checklist questions.

Additional security guidelines may be found in the Security Assessment Module. This module is free and is included with every subscription. It is used to develop and implement security plans and revisions to employee training programs to include security awareness.

Dakota Software released Tracer 6.0, web-based corrective action tracking software. Enhancements in Tracer 6.0 include a change in the Journal to display only user-added notes. An "audit trail" of all other activity associated with the action is now kept in the Event Log. The new Attachments feature lets you attach pictures, documents or web links to any action item.

The reporting capabilities have been substantially upgraded. Clicking on the new Report button displays selected items in a Microsoft Access or Excel Report Template. Now you can build your own custom report, or have Dakota Software build you one, that has just the data you want displayed the way you want it.

The new Archive feature removes old actions from view but retains them in the database for future data analysis. A new security level, called "Full Access" has been added to allow access to the archive feature.

Getting new Tracer users started is easier with the new introductory e-mail message and Tracer Pictorial Guide built in to the Add New User function.

Air Quality

EPA has taken the first step toward regulating greenhouse gases (GHG) with its proposed Mandatory Greenhouse Gas Emissions Reporting rule. The rule applies to fossil fuel suppliers, industrial gas suppliers and facilities that directly emit GHGs. EPA also proposed to revise existing mobile source regulations to require manufacturers of vehicles and engines to report GHG emissions under the existing reporting framework for EPA's long-established criteria pollutant emissions control programs and vehicle fuel economy testing program.

Significantly, the proposed rule would not require control of GHGs; it would only require that sources above certain threshold levels monitor and report emissions. The intent of the proposed rule is to collect accurate and comprehensive emissions data to inform future policy decisions.

Abridged Protocols

Dakota Auditor V. 7.5 now includes an abridged protocol for "Hand and Portable Power Tools" in the Equipment Safeguards Module. Abridged Protocols are already available in the Water Quality, Solid and Hazardous Waste, and Worker Safety modules and in the Lockout/Tagout and Stairs, Ladders and Scaffolds topics of Equipment Safeguards. Three major highlights of regulatory changes include: EPA"s reorganized General Permit intended to distinguish effluent limitations from the requirements related to the development of the storm water pollution prevention plan (SWPPP); amended pipeline safety regulations which allow for an increase of maximum allowable operating pressure (MAOP) over that currently allowed; and the final rule requiring rail transporters of HW to annually compile and analyze data in support of safety and security assessments and routing decisions.

Dakota Software Releases Auditor Reference Database Version 7.3 with Significant Regulatory Updates

September 15, 2008---Cleveland, OH--- Dakota announces the release of Auditor Reference Database Version 7.3. Regulatory changes in this update reflect shifting political winds. With a nod to the impact of climate change, EPA issued an advance notice of proposed rulemaking (ANPR) noting the Agency’s responsibility for developing and issuing a mandatory Greenhouse Gas (GHG) emissions reporting rule by mid 2009. A note has been added to Dakota Auditor’s Reference Library in the Greenhouse Gas Emissions Module. This would be the first Federal rule specifically aimed at GHG emissions reporting. If you have reviewed Dakota’s GHG module and have preparations underway, you’re in a good stance. If not, call your Account Executive. The GHG module will facilitate any system for managing greenhouse gas emissions and supporting sustainability initiatives.

Other winds of change regarding climate change include EPA’s proposed new requirements under the Safe Drinking Water Act for underground injection of CO2, one of several options to reduce CO2 emissions to the atmosphere. The proposed requirements would include a new class of underground injection wells. You’ll find information in the Reference Library of the Water Quality Module and appropriate checklist and applicability questions for the proposed rule.

Feds follow up on States Commercial Learner’s Permit Standards for Trucking

If your company is trucking goods or you are driving personally on Interstate roads, you may be pleased to learn about the following program under review. A notice of proposed rulemaking for the Commercial Driver’s License (CDL) Testing and Commercial Learner’s Permit Standard has been issued to require new federal minimum standards for States to issue commercial learner’s permits. A note has been added to the Dakota Auditor Reference Library and citations added to the appropriate checklists in the Transportation Module.

Courts Rule the Clean Air Interstate Rule (CAIR) Has Fundamental Flaws

The United States Court of Appeals for the DC Circuit has vacated the CAIR. Because of fundamental flaws, the Court states it cannot be considered an acceptable rule. Although the vacatur has not yet been published in the Federal Register, a summary note has been added to Dakota Auditor’s Reference Library and citations were added to appropriate applicability and checklist questions in the Air Quality Module.

Rural Pipelines Once Exempt from Regulations are Now Included

The Pipeline Hazardous Materials Safety Administration (PHMSA) issued a final rule that states operators of all rural low-stress pipelines must now comply with reporting requirements of 49 CFR 195, Subpart B. Operators of large diameter, high risk, low-stress pipelines must now comply with ALL the 49 CFR 195 requirements. New applicability and compliance questions have been added to Dakota Auditor’s Pipeline Safety Module.

NEW International Modules

Dakota’s International Protocol collection, authored by ENHESA-EPC, now includes Germany-Federal which is available in a dual language English and German version. This release also includes an updated version of Belgium-Flanders.

May 27, 2008 - Dakota Software is pleased to present a new Greenhouse Gas Emissions (GHG) Module, that is included in the newest Auditor release V. 7.2. The module includes detailed coverage of the two voluntary U.S. GHG reduction programs and will facilitate any system for managing greenhouse gas emissions.

Auditor 7.2 also includes new versions of Malaysia, United Kingdom-Scotland, Australia-South Australia and Italy in its international module collection, authored by ENHESA-EPC.

The courts have recently vacated a number of regulations. Although the regulations will be revised or removed at a future date, Auditor customers will want to check the Air Quality Module and Spills Module for the update about regulatory relief.

All Dakota Software as a Service (SaaS) customers who are hosted by Dakota were upgraded automatically and are licensed for the new GHG emissions module.

February 6, 2007---Rochester, NY--- Dakota announces the release of Auditor Version 6.8. The highlights of regulatory changes in Version 6.8 include Sealed Sources Transactions Upcoming Compliance Deadlines. The final rule issued by the Nuclear Regulatory Commission implementing the National Source Tracking System for transactions involving sealed sources, requires the licensee to report information on the manufacture, transfer, receipt, disassembly and disposal of nationally tracked sources. Compliance dates for initial inventory submitted to the National Source Tracking System are Nov. 15, 2007 and Nov. 30, 2007 for Category 1 and Category 2 Sources respectively. The Dakota Auditor Reference Library and applicability and checklist questions have been updated to include the new information in the Chemical and Physical Exposures Module as well as the Solid and Hazardous Waste Module.

New Ground Water Rule for Drinking Systems

The new Ground Water Rule topic has been added to the Drinking Water section in the Water Quality Module. The rule establishes a risk-based approach to target ground water drinking systems that are susceptible to fecal contamination, requiring source water monitoring at targeted systems and corrective actions for systems with an identified significant deficiency or evidence of fecal contamination. The final rule, effective Jan. 8, 2007 applies to ground water systems that do not combine all of their ground water with surface water or with ground water under the direct influence of surface water prior to treatment under 40 CFR 141.

The highlights of regulatory changes in Version 6.4 include information in the Solid & Hazardous Waste module about the Nuclear Regulatory Commission’s proposed amendment to the regulations implementing a National Source Tracking System for certain sealed substances. The Chemical & Physical Exposures module contains information regarding this proposal also as each licensee who manufacturers, transfers, receives or disposes of a nationally tracked source would be required to complete and submit NRC Form 748. The licensee’s initial inventory of nationally tracked sources would have to be provided and then annually verified and reconciled with the actual inventory.

 

The Air module reflects EPA’s final published rule establishing standards of performance for mercury for new and existing coal-fired electric utility steam generating units. The final rule revised new source performance standards, added emissions guidelines and compliance times and revised continuous emissions monitoring requirements in 40 CFR 75.

 

The Federal Motor Carrier Safety Administration (FMCSA) proposed a new Federal on-line registration system that would apply to every motor carrier, freight forwarder and broker required to register with DOT under 49 CFR 390.19 or 49 U.S.C. 13901. The entities covered by a Unified Registration System would be required to register with FMCSA and periodically update registration information provided on a newly proposed registration form. Version 6.4’s Transportation module contains a summary of the proposed rule in the Reference Library with links to the appropriate checklist questions.

Changes in the Water Quality module reflect EPA’s delayed deadline from March 10, 2005 to June 12, 2006 for NPDES storm water discharge permit coverage from small construction activity at oil and gas sites. Additionally, the EMS/ISO 14000 module now includes revisions to the ISO 14001 and 14004 standards. Auditor is more critical than ever if you are 14000 certified as you now have to audit to legal requirements rather than just your management system.

Pipeline Safety- Operators of gas transmission pipelines located in high consequence areas (HCAs) are now required to develop Integrity Management Programs which require operators to perform ongoing assessments of pipeline integrity; to improve data collection, integration and analysis; to repair and remediate the pipeline as necessary; and to implement preventative and mitigative actions.

Full text coverage of the Integrity Management Program (49 CFR 192, Subpart O) is presented in the Reference Library along with appropriate applicability and checklist questions for those facilities subject to the Integrity Management Program requirements.

Transportation- The final rule establishing standards for Minimum Training Requirements for the operators of Longer Combination Vehicles (LCVs) and for the instructors who train these operators is effective June 1, 2004. A new part (49 CFR 380) was added to the Auditor Reference Library and a new LCV domain was added to the Transportation>Motor Carrier Safety topic.

Under the amended Federal Motor Carrier Safety Regulations (FMCSRs) (69 FR 16684), new or prospective employers are now required to seek minimum driver safety history performance data for applicants under consideration. The reporting capabilities have been substantially upgraded. Clicking on the new Report button displays selected items in a Microsoft Access or Excel Report Template. Now you can build your own custom report, or have Dakota Software build you one, that has just the data you want displayed the way you want it.

The new Archive feature removes old actions from view but retains them in the database for future data analysis. A new security level, called "Full Access" has been added to allow access to the archive feature.
